Gallery/Artist Agreement

We are thrilled to collaborate with talented artists like you and showcase your exceptional work in our 3000-square-feet of display space in our gallery located in the heart of historic downtown Kirkwood, Missouri. This agreement outlines the terms and conditions for the display and representation of your artwork at our gallery. By agreeing to these terms, you join us in our mission to elevate and celebrate representational art. We look forward to a successful and rewarding partnership!

Relationship Overview

This is an electronic agreement between you, an artist (referred to as the “artist”), and The Galleries of Heartland Art Club (referred to as the “Gallery”), a retail art gallery in Kirkwood, Missouri. The Gallery is operated by the non-profit (501)(c)(3) Heartland Art Club. The terms contained herein govern the display and representation of your artwork at the Gallery. By downloading, reading, and/or responding affirmatively and providing your full name in the space provided you are agreeing to all the terms contained in this agreement.

The agreement applies to artists the Gallery has confirmed for representation or exhibition. The agreement applies only to the artist’s works displayed at the Gallery and not to works that are not in its possession. The agreement does not confer upon the Gallery an agency relationship with the artist.

Both parties agree that at any time during the terms of the agreement the artist may request return of any individual unsold pieces. Retrieval of artwork or return shipping costs will be the responsibility of the artist.

The Gallery may amend this Agreement from time to time.

Both parties acknowledge this agreement may be terminated by either party for any reason at any time.

Artwork

All artwork must be created by the artist. Artwork must be original — prints and other reproductions will not be accepted unless there is a written exception.  Excluded from this rule are photographic prints and hand-pulled prints. 

Artwork created as demos or work created as part of a workshop will not be accepted.

All artwork whether on display in the gallery in an exhibit must be for sale unless prior arrangements have been made. 

Digital Media Policy

Heartland Art Club does not accept digital artwork. We recognize, however, that certain digital tools are widely used in photography and in preparing work for painting and sculpture, and this policy is not intended to exclude that kind of use. All artwork must be entirely original and created and signed by the artist. Every element of the piece, including any reference material incorporated into the final work, must be the artist’s own. No borrowed or licensed imagery may be part of the finished piece.

Reproductions and Giclee Prints
Reproductions and giclee prints of original artwork are not eligible for submission or display without prior gallery approval. Any approved reproduction must be signed and numbered as part of a limited edition. This policy excludes original, traditional, handmade printmaking, which remains eligible under standard show and gallery guidelines.

Artificial Intelligence
Images created wholly or partially through text-to-image generative AI systems are not eligible. This includes work that is painted, drawn, or otherwise physically rendered from an AI-generated image. The composition, concept, and content of the finished piece must originate with the artist, not with an AI tool, regardless of the medium used to execute it.

Enforcement
Artwork found to violate this policy is subject to disqualification from the current show and/or removal from the gallery. Artists with repeated violations or, if it is determined that the violation was intentional, the artist may be disqualified from future shows and from displaying work at the gallery.

Presentation

The artist agrees to provide works framed to Gallery standards in a condition ready for exhibition, including:

  • Wire hangers only.
  • Please examine the artwork, matting, glass, and frames for chips, breaks, missing finishes or paint, corner damage, or any other imperfections.
  • All artwork must be signed. Prints, when allowed must be signed and numbered.
  • All artwork on paper must be displayed under glass or plexiglass unless properly sealed.
  • Artwork must have an Inventory Form nicely taped to the back of the painting. The inventory form can be found HERE.
  • Contact the Gallery for sculpture specifications.

Shipping

Shipping of works to the Gallery and return shipping of unsold works is the responsibility of the artist. Airfloat™ or similar boxes are required to minimize damage to artwork in transit. Packing and shipping of sold works to the purchaser is the Gallery’s responsibility. Packing and shipping for return of artwork to the artist is the artist’s responsibility. Estimates for packing and shipping can be sent to the artist in advance of shipping.

Be sure to send us a note with tracking information to Art@HeartlandArtClub.org letting us know when your artwork is expected to arrive or be delivered.

Display of Artwork

The Gallery reserves the right to determine whether to display a work and where on its premises to display it. The Gallery makes no guarantee that artworks provided to the Gallery will be on display at all times. The Gallery does not guarantee any artwork will be sold.

Insurance

The Gallery provides general liability insurance only for its facility. The Gallery recommends the artist also insure his/her work, including shipping insurance for work shipped to and from the Gallery.

The Gallery makes reasonable efforts to secure, safeguard, carefully handle, carefully store, and carefully wrap (when sold) all artworks.

Sales

All artwork sold while at the Galleries of Heartland Art Club is subject to a commission of 25% for Heartland Art Club members and 35% for non-member artists. This commission is deducted from the sale price before payment is remitted to the artist. Sales paid by credit card are subject to an additional 3.5% processing fee, also deducted from the sale price. If you are not a member, please consider joining HERE.

Payment for Sold Works

The Gallery agrees to remit payment for a sold work to the artist within 30-45 days of the sale date. On rare occasions and in order to accommodate clients, the Gallery may offer an installment plan for purchase of artwork. In this case, payment to the artist will be made within 30-45 days of the final installment payment.

Use of Photos

Heartland Art Club may use photos of all artwork displayed at the Gallery, and artist information for use on its website, social media, and print materials.

Abandoned Artwork

Unless other arrangements or agreements have been made, all artwork must be picked up within thirty days after the close of a show or after the artist has been asked to pick it up. If the artist fails to pick up the artwork within the specified period, it will be deemed abandoned and become the property of Heartland Art Club, which may dispose of or sell it at its discretion.

Additional Requested Information

Artists applying for gallery representation are required to fill out the Artist Representation Application. 

For each artwork submitted, the artist must also complete the Artwork Approval Form.
